Texas Child Support Overview

In the state of Texas, the laws pertaining to family legal issues are somewhat progressive when compared to other states.  However, when it comes to child support payments, the laws are a bit antiquated and can even be harsh.  The laws governing child support payments are set forth by the Texas Family Code.  When judges are presiding over family law or child support cases, they will rarely deviate from the Texas Family Code, which usually means that the parent who does not have custody or possession of the child will be ordered to pay child support by the court.

When determining the amount of child support, the courts will follow “guidelines” that are outlined in the Texas Family Code.  However, parents should know that these guidelines tend to revolve around their salaries.  Aside from parents’ incomes, judges handling child support cases will pay attention to:

• the amount of time each parent spends with the child/has physical custody of the child
• each parent’s financial circumstances
• the other types of financial support a parent is offering in terms of medical insurance, schooling expenses, etc.
• the amount of children the parents have together
